Deputy U.S. Marshall Indicted for Unauthorized Data Access

Jose Magallan, a Deputy United States Marshal stationed in McAllen, Texas, was indicted on two counts of exceeding his authorized access to and providing information from the computers of the United States Marshal Service for private financial gain. The alleged incidents occurred between November 2006 and January 2007. 

The indictment, returned under seal by a Houston grand jury on April 18, 2007,  was unsealed following Magellan’s appearance before United States Magistrate Judge John W. Black in Brownsville, TX.   Magallan, 52, was arrested late Wednesday, April 25, 2007, in the McAllen area. His trial is scheduled to start on July 2, before Judge Vanessa Gilmore in Houston.

The prosecution is the result of an investigation conducted by special agents of the DOJ Office of Inspector General.  If convicted Magellan could receive a maximum punishment of five years imprisonment and a $250,000 fine for each count.

Magellan is a 17-year-veteran of the U.S. Marshall's office.
